GENERAL INFORMATION ABOUT TREE REMOVAL ON VACANT RESIDENTIAL LOTS
NOTE: This publication provides general information about rules for the City of Deltona. Other federal, state, or local laws and rules may also be applicable. Contact Construction Servicea at (386) 878-8650 to determine that no amendments have been made to this information before proceeding with any plans. Other requirements may also apply.


1.

A tree is defined as “any woody self-supporting plant characterized by having a single trunk of at least six inches (6”) Diameter-at-breast-height, hereinafter referred to as DBH or multi-stem trunk system with well-developed crown at least fifteen feet (15’) high as measured from its base”. See attached information.

2.

It is unlawful for any person or contractor to cut down, destroy, or remove any tree without first obtaining a TREE REMOVAL PERMIT, EXCEPT for the following situations. No permit is required when:

1.

There are no “trees”, as defined in paragraph one (1), on the property involved.

2.

Trees are removed as part of a bona-fide agricultural activity in agricultural areas;

3.

The trees being removed have deteriorated as a result of age, hurricane, storm, fire, disease, or other act of God;

4.

Trees are removed from public rights-of-way or easements for construction or maintenance purposes;

5.

Trees are planted and grown for sale to the general public or for some public purpose; or

6.

Trees are listed as nuisance trees (as listed in the Deltona Land Development Code, Ordinance 96-25, as amended)

Tree removal permits may be issued individually for vacant residential lots or in conjunction with a building permit or development order.

4.

Applications for a tree removal permit that is not part of a building permit or development order are available from the Department of Development Services.

For Single Family or Duplex dwellings only, trees removed inside the “buildable area” (see Figure 2) do not have to be replaced. Any trees removed outside the buildable area must be replaced. Replacement shall be based on replacing one-tenth (1/10th) of the total cross sectional area of the trunks of the trees being removed, except for Sand Pines. For Sand Pines, replacement is one twentieth (1/20th) of the total cross sectional area of the trunks of the trees being removed. The cross sectional area shall be taken at the DBH of the tree. Single trees may be replaced with two or more trees provided the cross sectional requirements are met. In no case, however, shall replacement trees be less than six feet (6’) in height with a DBH of less than one and one half inches (1 ½”). Replacement trees must be the same species as the trees being removed or an alternative species acceptable to the city.

Trees classified as “historic” or “specimen” trees cannot be removed without first obtaining a permit, regardless of the exemptions specified in paragraph 2 or the buildable area described in paragraph 5. A list of specimen trees and sizes is attached.

7.

Replacement tree calculations listing the ratio of tree inches removed to tree inches being replaced are attached.

8.

Once a permit is obtained the permit or a copy of the permit must be clearly posted on the job site until all work is completed.

9.

Trees may not be removed in a manner that substantially alters the natural grade of the land involved. Tree stumps may be ground down. However, root raking, grading, or fill material is not allowed under a tree removal permit.
